1. Data controller
Construvendo, the marketing company for the Olave Bay Tower project, Manga, Cartagena de Indias, Colombia. [TO CONFIRM: legal name, NIT, registered address and direct contact email of Construvendo — currently not declared in the fund's organizational chart; in the meantime, the channel is the contact form on the homepage].
2. What data is collected
- Contact form (`/contacto`): name, phone, email, city and an optional message. They are stored in `olave-bay.db`, the database of this site.
- Payment simulator (`/simular`): the budget you enter is used for the calculation and is NOT stored anywhere — it is a calculation, not a record.
- Cookies: this site sets no first-party or third-party cookies. There is no external analytics or trackers: everything the page loads comes from this same site.
3. Purpose
The contact form data is used solely so that a Construvendo advisor can contact you about Olave Bay Tower — no other purpose, in accordance with Ley 1581 de 2012 (Colombia).
4. Where data is stored and with whom it is shared
The data lives in `olave-bay.db`, a database owned by this site, on the machine that serves it. It is not sold or shared with third parties other than the sales team of Construvendo.
5. How long data is kept
[TO CONFIRM: retention period for the contact form leads — it is not yet declared in the fund's Document Retention Table (`retention.toml`); it will be added when the project defines it]. In the meantime, a lead is kept while the project remains in sales or until you exercise the right to erasure described below.
6. Your rights (Ley 1581 de 2012 and Decreto 1377 de 2013)
As the data subject you have the right to access, update, rectify and erase your data, and to revoke your authorization where applicable (Ley 1581, art. 8; Decreto 1377, art. 5). To exercise it, write through the contact form on the homepage.
Response deadlines, as set by Ley 1581 (arts. 14 and 15):
- Inquiries (to know what data exists, and where it came from): are handled within a maximum of 10 business days from receipt. If that is not enough, notice is given before that deadline expires, with the actual response date — which can never exceed 5 additional business days.
- Claims (to correct, update, erase, or revoke authorization): are resolved within a maximum of 15 business days from the day following receipt. If that is not enough, notice is given before that deadline expires, with the actual response date — which can never exceed 8 additional business days.
7. Visitors from the European Union (GDPR)
For those visiting this site from the European Union: the controller is Construvendo (contact details above); the legal basis for the contact form is your own consent when submitting it; there is no external recipient of the data; and you have the same rights of access, rectification, erasure, restriction, objection and portability described above, plus the right to lodge a complaint with the data protection authority of your country of residence in the EU.
